At Systec Media, we value our clients and wish to provide them with the most pleasant experience possible. We offer website design, hosting services, and domain for individuals, businesses, and organizations. Systec Media makes no warranties (expressed or implied) as to the appropriateness of the products and services we offer for any purpose whatsoever. The policies are planned to make Systec Media’s products and services available to all of our Customers as efficiently and consistently as possible. We assure you that your website will remain hosted on our servers as long as you agree and obey to the conditions detailed within. In order to offer you the best service, all clients that use any of Systec Media services must agree to all of the terms and conditions detailed below.
Website proposals rates and other agreements are only valid when a partner of Systec Media, signs the written document. Regardless of the place of signing of this agreement, the client(s) agree that for purpose of venue, this contract was entered into in South Carolina and any dispute that may arise will be litigated or arbitrated in South Carolina.
All of the content and services that you offer must be used for lawful purposes only. Your site may contain Chat Rooms, Message Boards, Web Pages, E-mails, Contact Forms, and other services that enables information to be sent or posted for others to view. None of the content may violate any Local, State, or Federal Laws. You cannot display, publish, or submit in any form; inaccurate, dishonest, threatening, illegal, hateful, vulgar, abusive, disreputable, distasteful, infringing, and/or pornographic content. You may not use our services to assist other people in committing any Local, State, and/or Federal laws.
Systec Media is not obligated to examine available content; however, we have the right to do so. You acknowledge that if we are made aware of any content that is determined to be against our regulations, which are mentioned above, we reserve the right to edit, remove, or deny access to any and/or all of the content that you have on our server. Your customer account may be disclosed to the proper authorities to satisfy any law, regulation, or ordinance that you violate. Systec Media will be/remain the sole judge of the propriety of your website. Systec Media restricts the sale of advertisements on your website and we bear no responsibility for the nature and/or content of your site. By continuing to use Systec Media’s services it is implied that you agreed to the current terms/conditions in this policy. We reserve the right to change the terms/conditions of our policy at any time and for any reason without notice.
Clients may not attempt or perform any action on our network to alter/delete user authentication or security of any host, network, or account. This includes, but is not limited to, changing/accessing data that is not intended for the customer/account, clients may not access any account/content on the server that they are not (expressly and/or implied) authorized to access, looking for weakness of security on Systec Media’s server is strictly prohibited, or violation of any other organization’s security policy. Customers are not allowed to deny services to other users/accounts by, but not limited to, bulk e-mailing, flooding, information overload, accessing and/or providing viruses, Trojans, adware, and/or spyware.
We will grant the proper law enforcement authorities the rights/privileges to access our server(s) for, but not limited to, investigation of criminal violations, or violations of any code, law, or ordinance on the local, state, of federal level. Systec Media assumes no liability for those that violate our terms and users who violate our server security may incur criminal or civil liability/charges. If a client/business violates our network security policy in any way we reserve the right to terminate the account(s) without notice and all fees for products/services provided by Systec Media will not be refunded under ANY condition.
If any client attempts or performs any action on our network to, but not limited to, alter/delete user authentication, delete/modify security of any host, network, or account related to Systec Media, or damages the server or any connection databases by means of, but not limited to, spam, mail bombs, flames, bots, unsolicited e-mails and/or adware, spyware, Trojans, or viruses of any sort (intentionally only on the adware/spyware/Trojans/viruses) will be permanently removed from our clientele (both website/graphic design/web hosting, and/or any other services provided by Systec Media). The client(s) must also pay for the damages that he/she/they caused and a minimal fee of $75 per hour that is used to restore and/or repair the server and any information that was currently on the server.
Each account will allow features such as message boards, shopping carts, chat rooms, etc and Systec Media prohibits our clients from adversely affecting our server’s performance, or security in any form. CGI-script sharing with our domains not hosted by Systec Media is not allowed. Our clients are prohibited from having/operating IRC or any Bots of any kinds on the servers in the Systec Media network. Any website that uses an outstanding amount of resources will be given an option of upgrading their services or paying an extra fee. Systec Media prohibits the use of background daemons; however, our staff will consider request with a per application basis.
You are not allowed to make any connection by using your account on the Systec Media’s Server(s) to send, but not limited to, spam, mail bombs, viruses, Trojans, spyware, adware, flames, bots, and/or unsolicited e-mails. If you are found to violate our advertisement policy we reserve the right to terminate your account and/or domains without notice and all fees for products/services provided by Systec Media will not be refunded under ANY condition. If you or your clients are found to have sent spam, mail bombs, flames, bots, unsolicited e-mails and/or adware, spyware, Trojans, or viruses of any sort (intentionally only on the adware/spyware/Trojans/viruses) using our server or domains linked to our server we reserve the right to terminate both your account and any domains leading to our servers (without refund of any services/products our company has provided). Additionally, Systec Media will impose a $250 penalty for each spamming attempt and your account will be cancelled.
Systec Media reserves the right at its sole discretion to refuse or cancel service. Violation of any terms in the copyright, terms of use, or user agreement provided by Systec Media will result in warning, suspension, or Account Termination.
All customers and/or users must agree that it will hold Systec Media harmless from any liability, losses, expenses, claims, or stipulations and claims, as well as attorney’s fees assessed against Systec Media, its agents, customers, officers, employees, partnering organizations, or administration that may arise/result from services/products provided/performed/agreed to be performed. All clients must agree to defend and hold Systec Media harmless against any liabilities arising from, but not limited to; injury to person or property caused by products that are associated with Systec Media in any way, any infringing on the rights of any third party, and/or copyright violation of any defective products sold to a customer from and/or associated with Systec Media.
Payments are due upon the due date stated on the invoice (typically 30 days). If for any reason this fee is late, every 15 days a surcharge of 10% will be added to the balance due. If the full payment along with any late fees are not made within 45 days after an invoice is issued, access to the website and/or the account will be denied. Accounts may be reactivated for a service fee of $50. Systec Media reserves the right to remove access to portions or the entire site until payment is made. Removal of portions or the entire site will begin 15 days after the invoice is due.
All payments will be made in US funds by cash, checks, money orders, and Visa, MasterCard, American Express, or Discover via Paypal. Cash payments must be received with a liable witness and accompanied with an invoice stated paid (the invoice must be signed by the proprietor of Systec Media, the client(s), and any witnesses with the date and time).
Accounts that are terminated due to a policy violation or late payments will not be refunded. If Systec Media agrees to allow the client to reactivate their account after 15 days of termination, an outstanding surcharge of $50 must be paid to reactive the account; however, we reserve the right to refuse any client who has violated any of our policies.
Hosting accounts on Systec Media’s servers must be paid in for on a yearly basis and are non-refundable. If an account on Systec Media’s server goes over its monthly bandwidth it will be prorated for the time used based on a specified monthly rate. If an account is terminated with an outstanding balance, the domain name(s) will remain the property of Systec Media and can not be transferred until the account is paid in full. After 45 days, domains are forfeited by our clients and become the sole property of Systec Media. If a site is hosted on one of our partnering organization, instead of directly on our servers, Systec Media shall not be responsible for any downtime, billing, or ANY other issues that may arise. Sites that are not hosted on Systec Media’s servers are subject to different cost for overage in bandwidth and/or server storage.
Systec Media will make a reasonable effort to provide a high standard of quality for its products and/or services. No guarantees are made by Systec Media regarding the availability, dependability, timeliness, or usefulness of any/all of our products and services. The terms defined in our copyright information, privacy policy, terms of use, and user agreement serve as the License Agreement for Systec Media, therefore you must agree/abide by these policies to use and/or view Systec Medias site(s), products, and or services.
Any violation of our policies may result in the cancellation of products and/or services provided by Systec Media WITHOUT notice and refund!
